2. Description of Services
Kitchen Optimizer provides virtual brand creation, menu optimization, and delivery platform management services for restaurants. These services include:
- Virtual brand concept development
- Menu creation and optimization
- Delivery platform setup (DoorDash, UberEats, Grubhub)
- Ongoing listing optimization
- Branding and design services
3. Service Agreements
By purchasing any of our services, you agree to the following:
- You are the owner or authorized representative of the restaurant business
- You have the legal right to use all menu items and materials provided
- You will provide accurate and complete information
- You will comply with all applicable laws and regulations
4. Payment Terms
Service fees are as listed on our website at the time of purchase. Payment is due upon completion of the initial consultation unless otherwise agreed. We reserve the right to pause or suspend services if payment is not received within the agreed timeframe.
5. Refund Policy
We offer a satisfaction guarantee for our services. If you are not satisfied with our work, please contact us within 30 days of service completion to discuss resolution. Refunds are considered on a case-by-case basis.
6. Client Responsibilities
As a client, you agree to:
- Prepare menu items as specified in your virtual brand concepts
- Maintain food quality and consistency
- Respond to customer inquiries and orders promptly
- Provide feedback and collaboration as needed
7. Intellectual Property
All branding materials, logos, and concepts created by Kitchen Optimizer remain our intellectual property until full payment is received. Upon payment, you receive ownership of custom deliverables created specifically for your brands.
8. Limitation of Liability
Kitchen Optimizer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. We do not guarantee specific revenue outcomes or delivery platform performance.
9. Delivery Platform Compliance
You agree to comply with all terms and conditions of delivery platforms (DoorDash, UberEats, Grubhub, etc.) where your virtual brands are listed. Kitchen Optimizer is not responsible for platform policy changes or account suspensions.
10. Confidentiality
We treat all client information as confidential. We will not share your business information, recipes, or operational details with third parties except as necessary to provide our services.
11. Termination
Either party may terminate this agreement with written notice. Upon termination:
- Services will be discontinued within 30 days
- Any unpaid fees remain due
- Confidentiality obligations survive termination
12. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of our services after changes constitutes acceptance of the new terms.
13. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
